New York state introduced the SHIELD Act in July, which significantly alters data privacy and security regulations for ALL businesses operating in New York. Is your organization compliant?

  • On July 25, 2019, New York Governor Andrew Cuomo signed into law the Stop Hacks and Improve Electronic Data Security Act ("SHIELD Act") amending New York's data breach notification law. 
  • New data security requirements for New York take effect on March 21, 2020. 
  • Associations, foundations, and other nonprofits must be aware of these new regulations to avoid a wide range of costly issues. 

 The Stop Hacks and Improve Electronic Data Security Act ("SHIELD Act") was signed into law this summer, and with it came significant changes to current data privacy regulations, including: 

  • Broadening the Definition of "Private Information” to include basic information like a username/email address in combination with a password or security questions and answers. 
  • Expanding the Definition of "Breach" to include unauthorized access, which is MUCH broader than the previous (and much narrower) definition of unauthorized acquisition. 
  • Under the new act, there is a new breach notification requirement that covers any person or business that owns or licenses private information of a New York resident (vs business that just conduct business in New York). 
  • Mandating that all companies A company implement a data security program containing specific measures, including risk assessments, employee training, vendor contracts, and timely data disposal. 

While some of these requirements have already taken effect, others go into effect on March 21, 2020.
